RaceSolution

Terms and Conditions

Last updated: 7 November 2026 (version 2026-11-07)

1. About these terms

RaceSolution is a race management, timing and safety platform operated by Chris Bainbridge, trading as Bainbridge Services, a sole trader registered in Mauritius (Business Registration Number I25008115), of 30 Calodyne Bungalows, St Francois, Riviere du Rempart, Mauritius 31726 ("we", "us", "our"). These terms form the agreement between us and the organisation that creates a RaceSolution account ("you", "the Customer").

By creating an organisation, or by using RaceSolution on behalf of one, you agree to these terms, our Refund Policy and our Privacy Policy. The person who creates the organisation confirms that they are authorised to accept these terms on its behalf.

2. Definitions

  • Service - the RaceSolution website, web application, mobile apps and APIs, including the RaceTiming and RaceSafety modules.
  • Users - people you invite to or allow onto your organisation's account, such as administrators, race directors, timers and field staff.
  • Participants - racers and other people whose details you enter into the Service for your events.
  • Customer Data - all data you or your Users put into the Service, including event, participant, timing, gear check, incident, location and medical data.

3. Accounts

  • You must give accurate details when you sign up and keep them up to date.
  • You are responsible for everything done under your organisation's account, including by your Users. Keep passwords secure, give each person their own login, and remove access for people who no longer need it.
  • You control which Users can see sensitive data, such as medical information, through the permissions in the Service. Grant that access only to people who need it for the safety of your event.
  • Tell us promptly at [email protected] if you suspect unauthorised access to your account.

4. Plans

The Service is made up of modules, currently RaceTiming and RaceSafety. Each is available on a free plan with usage limits (for example a maximum number of participants per event) or on a paid plan. The current limits, features and prices are shown on our pricing page and in the billing section of the app.

We may change or improve the Service over time. If we remove a feature that is a material part of a paid plan during your billing period, you can ask for a pro rata refund for the rest of that period.

We may change free plan limits at any time. Where a change would affect an event you have already set up, we will try to give you reasonable notice.

5. Fees, billing and Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries relating to payment and handles returns. When you buy a paid plan you also agree to Paddle's Buyer Terms.

  • Annual subscriptions. Paid plans are billed yearly in advance, and their price is based on the plan and the number of paid seats (such as administrators, timers or field staff).
  • Automatic renewal. Subscriptions renew automatically at the end of each year unless you cancel auto-renewal before the renewal date. You can do this at any time from the billing section of the app or through Paddle's customer portal.
  • Changes during the year. If you add seats or modules part way through a year, you are charged straight away for the remainder of the current year, pro rata.
  • Tax. Prices shown may exclude VAT or sales tax. Paddle calculates and collects any tax due at checkout.
  • Price changes. We may change our prices. A change will not affect a period you have already paid for, and we will give you at least 30 days' notice before it applies to a renewal.
  • Failed payments. If a payment fails and is not resolved, we may move your organisation to the free plan, with its limits, until payment is made. Your data is not deleted because of a failed payment.

6. Cancellation and refunds

You can cancel auto-renewal at any time and keep your paid features until the end of the period you have paid for. Refunds are covered by our Refund Policy.

7. Your data and your responsibilities

  • You own your Customer Data. We use it only to provide and support the Service for you, as described in these terms and our Privacy Policy. We do not sell it or use it for advertising.
  • You are the data controller for personal data about Participants and Users that you put into the Service, and we act as your data processor. You are responsible for having a lawful basis to collect and use that data and for telling the people concerned how it will be used, for example in your event entry terms.
  • Medical and other sensitive data. RaceSafety lets you record medical information (such as conditions, medications and allergies), emergency contacts, gear checks, incidents and staff locations. Medical information is special category data under data protection laws such as UK GDPR, EU GDPR and the Mauritius Data Protection Act 2017. You are responsible for having a valid condition for processing it, usually the Participant's explicit consent, and for collecting only what your event's safety needs. Access to medical records is logged.
  • Public pages. Some features publish information, for example live results and race pages. You decide what is published and are responsible for making sure Participants have agreed to it.
  • Export. You can export your event data from the web app, and we will help on reasonable request.

8. Data processing terms

Where we process personal data on your behalf, we will:

  • process it only on your documented instructions, which are these terms and your use of the Service, unless the law requires otherwise;
  • make sure anyone we authorise to process it is bound by confidentiality;
  • take appropriate technical and organisational measures to keep it secure, including encryption in transit, per-organisation access controls and audit logging of medical data access;
  • use only the sub-processors listed in our Privacy Policy, under contracts with equivalent data protection obligations. We will tell you about new sub-processors before they process your data, and you may object;
  • help you, as far as reasonably possible, to respond to requests from people exercising their data protection rights and to meet your security, breach notification and impact assessment obligations;
  • tell you without undue delay after becoming aware of a personal data breach affecting your data;
  • delete your personal data at the end of the agreement, unless the law requires us to keep it (see section 17), after giving you the opportunity to export it; and
  • give you the information you reasonably need to show compliance with these obligations, and allow and contribute to reasonable audits.

Your data is stored on Google Cloud infrastructure, as described in our Privacy Policy. We operate from Mauritius, and we and our sub-processors may access or process personal data outside the UK and European Economic Area. Where the data protection law that applies to you requires safeguards for such transfers (for example the UK International Data Transfer Addendum or the EU Standard Contractual Clauses), those safeguards form part of these terms.

9. Safety features are an aid, not a safety system

RaceSafety and the related timing features (such as overdue alerts, estimated positions, live locations and incident logging) are tools that help your team. They do not replace your event's own safety plan, medical cover, communications or emergency procedures.

  • RaceSolution is not an emergency service. In an emergency, always contact the emergency services directly.
  • The Service depends on phones, batteries, GPS and network coverage, as well as on the accuracy of the data your team enters. Positions, estimates and alerts may be late, inaccurate or missing, especially in remote areas. The mobile apps are designed to work offline and sync later, but data entered offline is not visible to others until the device reconnects.
  • You remain responsible for the safety of your event and for every decision about Participants, including who starts, who is withdrawn and how incidents are responded to.

10. Timing and results

Timing records, rankings and results are calculated from the data you and your Users enter. You are responsible for checking results before you publish them as final or use them to award prizes, places or qualifications. We are not responsible for disputes between you and Participants about results.

11. Acceptable use

You must not, and must not let anyone else:

  • use the Service in breach of any law, including data protection law;
  • try to access another organisation's data, or probe, scan or test the Service's security without our written permission;
  • interfere with or overload the Service, or get around its plan limits;
  • upload malicious code, or content that is unlawful, defamatory or infringes anyone's rights;
  • resell, sublicense or provide the Service to third parties, except to your Users for your own events;
  • copy, reverse engineer or build a competing product from the Service, except where the law allows this.

12. Mobile apps

The RaceSolution mobile apps are covered by these terms as well as the terms of the app store you download them from. Apple and Google are not parties to these terms and have no responsibility for the apps or their support.

13. The public demo

The demo event and its sign-in details are public and shared with every visitor, and it is reset regularly. Do not enter real personal data into the demo. Anything you enter may be seen by other visitors and will be deleted at the next reset.

14. Availability and support

We work to keep the Service available and reliable, but we do not promise it will be uninterrupted or free of errors. We may need to carry out maintenance, and where we can we will schedule planned work outside the times we expect events to be running. Support is provided by email at [email protected].

15. Intellectual property

We own the Service and all intellectual property in it. While these terms are in force we give you a non-exclusive, non-transferable right to use it for your own events. You give us a licence to host, copy and display your Customer Data only as needed to provide the Service. If you send us feedback or suggestions, we may use them without any obligation to you.

16. Liability

  • Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
  • Subject to that, we are not liable for any loss of profits, revenue, business, goodwill or data, for the cancellation or disruption of an event, or for any indirect or consequential loss.
  • Subject to that, our total liability arising out of or in connection with these terms in any 12-month period is limited to the greater of (a) the fees you paid us in the 12 months before the event giving rise to the claim and (b) £100.
  • You are responsible for claims made against us by your Participants or Users that arise from your events, from Customer Data, or from your breach of these terms or of data protection law.

17. Suspension and termination

  • You can stop using the Service at any time, and ask us to delete your organisation by emailing [email protected].
  • We may suspend or close an account that seriously or repeatedly breaches these terms, or where we need to in order to protect the Service, other customers or Participants. Where reasonable, we will warn you first and give you a chance to put things right.
  • We may stop providing the Service by giving you at least 90 days' notice, and will refund any fees paid for the period after it ends.
  • When an organisation is closed, you have 30 days to export your data, after which we delete it, except billing records and anything else the law requires us to keep.

18. Changes to these terms

We may update these terms. If a change is material, we will tell your organisation's administrators by email or in the app at least 30 days before it takes effect. If you do not agree to the change, you can cancel before it takes effect and receive a pro rata refund of any prepaid fees for the rest of your billing period. Continuing to use the Service after the change takes effect means you accept the new terms.

19. If you are a consumer

RaceSolution is intended for organisations such as clubs, charities and event companies. If you use it as an individual consumer, you have legal rights that these terms do not affect, and any limitation in these terms applies only as far as consumer law allows.

20. General

  • These terms, together with the Refund Policy and Privacy Policy, are the whole agreement between us about the Service.
  • We are not responsible for delays or failures caused by events beyond our reasonable control.
  • If any part of these terms is found to be unenforceable, the rest stays in effect.
  • You may not transfer your rights under these terms without our consent. We may transfer ours to a successor of our business.
  • Nobody other than you and us has any right to enforce these terms.
  • These terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of the Republic of Mauritius, and the courts of Mauritius have exclusive jurisdiction. If you are a consumer, this does not take away any protection you have under the mandatory laws of the country where you live, or your right to bring a claim there.
